The law firm Parker & McConkie first mentioned the photo’s existence in a November 2022 wrongful-death lawsuit against the Moab Police Department.
On August 12, 2021, the couple was pulled over by two Moab police officers after an anonymous 911 caller reported seeing a man (Brian Laundrie) hits Gabby.
Her parents believe she was killed by her fiance, Laundrie, on or around August 28, 2021. His body was discovered on September 19, 2021 in Grand Teton National Park.

The former couple were on a highway national park cruise when the crash, traffic stopped and Gabby’s untimely death occurred.
The disturbing photo was taken by Gabby shortly before cops pulled over her white convertible van for reckless driving. Laundrie was driving the car at the time of the traffic stop.

“According to the available data, the picture was taken at 4:37 p.m., at or before the approximate time of the first emergency call,” the family’s lawyer said in a statement on Tuesday.
According to the civil complaint, “Gabby took a photo of her injury showing blood on her nose and left eye.”
Gabby allegedly showed her injury to Moab Police Officer Eric Pratt.
Her family argues that Officer Pratt ignored her and “did nothing to investigate or document the injury.”
Both Petito and Schmidt believe Gabby would still be here today if the Moab City Police Department and responding officers had investigated and intervened more.

In fact, Gabby’s parents asked an outside investigator to look further into the traffic stop, where several “accidental mistakes” were made.

According to the lawsuit, Moab City PD improperly identified Gabby as the “dominant aggressor” in the altercation.
“Moab police failed to recognize the forceful grasping of Gabby’s face and the blocking of her nose, mouth and airways, which were critical precursors to her death by asphyxiation within a short period of time,” they said. “The Moab Police Department failed to interview Gabby, investigate her injuries and the severity of her assault, and failed to follow their own training, policies and Utah law.”
Gabby is believed to have been strangled and crushed to death by the Laundrie.
